  1. These Terms Apply: These Terms & Conditions together with the Terms of Use, Copyright and Online Privacy ("Terms") set out the conditions that apply to your use of the Online Notice of Disposal System ("NOD System"). By using the NOD System you agree to abide by these Terms together with all relevant guidelines, instructions and procedures ("Instructions") posted on this site. Nothing in these Terms limits or qualifies your rights or obligations under any legislation, including legislation relating to motor vehicles, traffic, roads or road transport.
  2. Changing These Terms: Roads and Maritime Services (RMS) may change these Terms or our Instructions from time to time by republishing them online. You accept that by doing this, RMS and Service NSW have provided you with sufficient notice of the variation. You should read the Terms and Instructions each time before you use the NOD System in case they have changed. If you do not agree to any change, you should not continue to use the NOD System.
  3. Precondition: To use the NOD System you must be the person shown on RMS's records as the registered operator of the vehicle as at the date it was sold or transferred to the Buyer.
  4. Buyer's Personal Information: You warrant that the Buyer has agreed to you providing his or her personal information to Service NSW in your Notice of Disposal.
  5. Correct Details: You warrant that all the information you provide is correct. Under the Road Transport Act 2013, it is an offence to attempt to transfer the registration of a vehicle by a false statement or any misrepresentation or other dishonest means.
  6. Disclaimer & Limitation of Liability: RMS and Service NSW do not promise that the NOD System is free from any computer virus, defect or contamination, or that the NOD System will be available for use at all times or any particular time. RMS and Service NSW are not liable for any loss suffered by you or anyone else for any reason as a result of the unavailability, non-performance or your use of the Service (including any failure to record your Notice of Disposal correctly or at all). To the extent that the Australian Consumer Law applies, RMS's and Service NSW's liability is limited to the re-supply of the service or a refund of fees paid by you when using the NOD System.
  7. Definitions
    "Buyer" is a person to whom the registration of the vehicle is being transferred (whether or not any price was paid).
    "Notice of Disposal" means the online Notice of Disposal Form in which you notify RMS of the details of sale or transfer of your vehicle.
  8. Age: If you are under 18, you may ask us to provide this service only with the involvement of a parent or guardian.
  9. Jurisdiction: These Terms and your use of the NOD System are governed by the laws of New South Wales, Australia and you agree to submit to the exclusive jurisdiction of the courts of New South Wales, Australia.
  10. General: A reference to any legislation includes all delegated legislation made under it, including regulations and rules, and amendments, consolidations, replacements or re-enactments of any of them. A reference to an entity, whether statutory or not, which ceases to exist or whose powers or functions are transferred to another body is a reference to the body which replaces it or which substantially succeeds to its powers or functions. Specifying anything in these Terms after the words 'include' or 'for example' or similar expressions does not limit what else is included.

Privacy & Security

Service NSW is providing certain customer service functions relating to Roads and Maritimes Services (RMS) products and services and must collect and otherwise handle your Personal Information for this purpose in accordance with this Privacy Statement. Service NSW may also disclose to RMS any information obtained from you in connection with performing these customer service functions.

RMS is collecting your personal information in connection with your notice of disposal of a vehicle and may retain and use it for driver licensing, motor vehicle, road transport or road safety purposes.

Providing this information is voluntary but RMS cannot process your notice without it and you may be held liable for offences in respect of the vehicle until the notice is recorded.

RMS may disclose your personal information to other driver licensing and vehicle registration agencies, to assess your application or verify the information you provide. RMS may also disclose it to confirm that compulsory insurance is current, in respect of inquiries relating to motor accidents, stolen or abandoned vehicles, to anyone proposing to acquire an interest in your vehicle and to any joint registered operator of your vehicle.

Otherwise RMS will not disclose your personal information without your consent unless authorised by law.
